When do I become Danish tax resident as an American?

Short answer: Danish full tax liability generally begins when you take up residence by acquiring a home available to you in Denmark and start actually staying there, or, failing that, once a continuous stay in Denmark exceeds a set period. It is a facts-and-circumstances test, not something your visa, employment contract or intention alone decides.

Why it works this way

Denmark's residence test looks at whether a home is available to you in Denmark and whether you have taken up genuine residence there, rather than relying on a single bright-line day count in every case. Acquiring or renting a home and moving your life there is generally what starts the clock, separate from whichever visa or work-permit route brought you.

This matters because the date Danish tax residence begins is also the date the asset-value snapshot for lagerbeskatning and other annual tax computations starts to apply to you. Arriving mid-year with large unrealised gains sitting in non-US funds can mean a full year of mark-to-market exposure starts immediately.

Short, preparatory stays — looking for housing, signing a lease, moving belongings — are generally tolerated without triggering residence, but the line between preparation and taking up residence is a facts-and-circumstances judgment, and it is worth getting written confirmation of your position rather than assuming.

Residence under Danish domestic law and residence under the US–Denmark treaty's tie-breaker rules are not automatically the same question if you retain ties to the US; the two need to be checked separately, particularly in the year you move.

The expensive mistake: Timing a move around salary start date rather than the housing date

People often assume Danish residency starts when Danish payroll begins. It can start earlier — from the date a home becomes available to you — which changes the lagerbeskatning base date and the researcher scheme eligibility window.

  1. Separate your housing date from your employment start date — Residence can begin with the home, independent of your first paycheck.
  2. Set your opening asset values deliberately — Lagerbeskatning uses value at the start of residence for many holdings; plan the position you want on that date.
  3. Check the treaty tie-breaker if you retain a US home — Dual-resident status needs its own analysis separate from the Danish domestic test.
